Please read these Terms of Use carefully before using the website www.trufasalonso.es, as well as the services offered by TRUFAS ALONSO S.L.. The responsibility for the use of the website lies with the user. Due to the use of this site, you accept the conditions of this agreement.

TRUFAS ALONSO S.L. offers the sale of gourmet products as well as information about their origins and procurement. TRUFAS ALONSO S.L. may alter at any time and without prior notice, the design, presentation and/or configuration of the Website, as well as some or all of the services.

1.4 Acceptance of the Terms of Use
The access and use of the TRUFAS ALONSO S.L. service implies by the User the full and unreserved acceptance of all the conditions contained in these Terms of Use.

2. USER REGISTRATION

TRUFAS ALONSO. S.L. requires the user to choose a user name and a password. The user will have to maintain under his exclusive responsibility the password, in the strictest and absolute confidentiality, assuming therefore, all damages and/or prejudices of all type derived from the breach or revelation of the same one, as well as of the bad use that, as consequence of the infraction of his duty of custody, could do a third party. In accordance with the provisions of Law 15/1999, December 13, Protection of Personal Data (LOPD), TRUFAS ALONSO S.L. reports the existence of a file of its ownership (registered with the Spanish Agency for Data Protection) which will include the data necessary to keep users informed that so require or provide services that users request. The holder may exercise the rights recognized in the LOPD on this file and, in particular, access, rectification or cancellation of data and opposition, if appropriate, as well as the revocation of consent for the transfer of their data under the terms provided in the LOPD. 2.1. Age
The services provided by TRUFAS ALONSO S.L. are available to users over 18 years of age who can fulfill legal contracts under the corresponding law. TRUFAS ALONSO S.L. may, at its sole discretion, deny access or use of the site to any person or entity. The user agrees to use the services and contents of the page in accordance with the law, morality, public order and these general conditions of use. Likewise, the user agrees to make appropriate use of the services and/or contents of the page and not to use them for illicit or criminal activities and/or activities that infringe the regulations on intellectual and industrial property, or any other forms of applicable legal order.

3.1 Rules of participation
TRUFAS ALONSO S.L. reserves the right to suspend or cancel, in whole or in part, with or without notice, any content or user account that violates these terms of use of the Service. By way of example, and in no case limited or exclusive, the user agrees not to perform any of the following activities:

  • a) offend, insult, discredit or harass other people in any common space of TRUFAS ALONSO S.L. Similarly, the user agrees not to use the contact tools of other users to perform such activities.
  • b) introduce or disseminate content or propaganda of a racist, homophobic, xenophobic, pedophilic, excessively violent nature, in support of terrorism or that violate human rights.
  • c) publish images of other people without their consent.
  • d) defaming or slandering companies, groups, NGOs, or any other group of individuals.
  • e) plagiarize, copy or use content from other persons or media without their consent.
  • f) impersonate other persons, groups or legal entities.
  • g) carry out commercial exploitation activities, such as the promotion of products and services, without the authorization of TRUFAS ALONSO S.L. generate spam, transmit unsolicited commercial messages, use the Service as a forwarding tool to another website or promote your site by publishing multiple and identical messages in different TRUFAS ALONSO S.L. spaces.
  • h) duplicating content. That is, copying and publishing, with or without the author's authorization, and systematically, content published on other websites.
  • i) add any software that hinders the normal operation of the system or any code, file or program that offers advertising through pop-ups. Similarly, the user agrees not to publish content that violates the conditions of use of advertising services used in TRUFAS ALONSO SL.
  • j) improperly use the functionalities of TRUFAS ALONSO S.L. to self-promote or improve the positioning of any website in search engine results.

4. ADVERTISING AND COMMUNICATIONS
By registering, the user accepts that TRUFAS ALONSO S.L. may send to his/her e-mail address newsletters that include advertising.

5. EXEMPTIONS OF RESPONSIBILITY
TRUFAS ALONSO S.L. is not responsible for the misuse of this website. TRUFAS ALONSO S.L. cannot guarantee the absence of viruses or other elements that could cause damage to computer systems, electronic documents or files of users of this site or third parties, so it is not responsible for any damage that may occur for these reasons.

7. GENERAL CONDITIONS OF SALE (GCS)
7.1 Identity of the contracting parties

And on the other hand, the CONSUMER, registered on the website by means of a user name and password, for which he/she has full responsibility of use and custody, and is responsible for the veracity of the personal data provided to the PROVIDER.

7.2 Subject matter of the contract

The present Legal Conditions of Sale (CGV), regulate the use of the online store of the website www.trufasalonso.es, for which Trufas Alonso S.L. is legally responsible.

The purpose of this contract is to regulate the contractual sales relationship between the PROVIDER and the CONSUMER when the latter accepts the corresponding checkbox during the online contracting process.
The contractual relationship of purchase and sale entails the delivery, in exchange for a specific price and publicly displayed through the website, of a specific product or service.

7.3 Applicable regulations
This electronic contract is concluded under Spanish law and specifically under the legal regime imposed by Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE) and the General Law 03/2014 for the Defense of Consumers and Users (LGDCU).
The electronic contract will not be filed by a third party and the language for its conclusion is Spanish. The present general conditions may be saved and reproduced at any time by the CONSUMER who makes a contracting through the options of his internet browser, and must be accepted before proceeding to the payment of the contracting.

7.4 Contracting Process and Language
The language of the contracting process is Spanish.
The CONSUMER, in order to access the products or services offered by the PROVIDER, must be of legal age and register through the website by creating a user account. Therefore, the CONSUMER must freely and voluntarily provide the personal data that will be required, which will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and the free movement of such data and Organic Law 3/2018 of 5 December (LOPDGDD) on the protection of personal data and detailed in the Legal Notice and Privacy Policy of this website.
The CONSUMER shall select a username and password, undertaking to make diligent use of the same and not to make them available to third parties, as well as to inform the PROVIDER of the loss or theft of these or possible access by an unauthorized third party, so that the latter may proceed to the immediate blocking.
Once the user account has been created, it is reported that in accordance with the requirements of Article 27 of Law 34/2002, of Services of the Information Society and Electronic Commerce (LSSICE), the contracting procedure will follow the following simple steps:

- Any product from our catalog can be added to the cart. In the cart, only the items, quantity, price and total amount will be displayed. Once the basket is saved, taxes, charges and discounts will be calculated according to the payment and shipping data entered.
- The baskets do not have any administrative link, it is only a section where you can simulate a budget without any commitment on both sides.
- From the basket you can place an order following the next steps for its correct formalization:

  1. Verification of invoicing data.
  2. Verification of the shipping address if different from the billing address.
  3. Selection of the payment method.
  4. Place the order (buy).

- Once the order has been processed, the system instantly sends an email to the PROVIDER's management department and another to the CONSUMER's email confirming that the order has been placed.
- Within a maximum of 24 hours, on working days, an e-mail will be sent to the CONSUMER confirming the status of the order and the approximate shipping and/or delivery date.

7.5 Payment Methods
Payment will be made by credit/debit card or Bizum through the secure payment gateway Redsys. Through this payment method, Trufas Alonso never collects or manipulates any customer data related to your card number. All data is processed directly by the payment entity, so that Trufas Alonso can always offer the greatest security, transparency and confidentiality in the transaction.
The cards currently supported by the payment gateway are Visa and Mastercard.

This merchant agrees not to permit any transaction that is illegal, or is deemed by the credit card brands or the acquiring bank, that may or has the potential to damage the goodwill of, or adversely influence them. The following activities are prohibited under the card brands' programs: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Purchaser, Issuing Bank, Merchant, Cardholder, or cards. In addition, the following activities are also explicitly prohibited: Sale of alcoholic beverages to minors under the age of 18.

7.7 Taxes and Invoices
The prices indicated for each product include Value Added Tax (VAT) and any other taxes that may be applicable. These prices, unless expressly stated otherwise, do not include the costs of shipping, handling, wrapping, shipping insurance or any other additional services and annexes to the product or service purchased.
The prices applicable to each product are those published on the website and shall be expressed in EURO currency (€).
Any payment made to the PROVIDER entails the issuance of an invoice in the name of the registered CONSUMER or the company name provided by the latter at the time of placing the order. This invoice will be sent together with the purchased product, as well as in PDF to the email address provided by the CONSUMER.

7.8 Dispute resolution
As required by the new European regulations, we inform consumers of the existence of a European dispute resolution platform for online contracting. Thus, for the resolution of consumer disputes (pursuant to Art. 14.1 of Regulation (EU) 524/2013), the European Commission provides an online dispute resolution platform which is available at the following link ➢.
